Mimosa products are subject to U.S. export controls. By selling, using, or otherwise transferring Mimosa products you are agreeing to comply with all applicable export and re-export control laws and regulations. These regulations include trade and economic sanctions maintained by the Treasury Department’s Office of Foreign Assets Control and the U.S. Department of Commerce. No person or entity may directly or indirectly sell, export, re-export, transfer, divert, or otherwise dispose of any Mimosa product, software, or technology (including products derived from or based on such technology) to any destination, entity, or person prohibited by the laws or regulation of the United States, without obtaining prior authorization from the U.S. government as required by those laws and regulations.

Mimosa products may not be transferred without a license to any country subject to U.S. embargoes or anti-terrorism controls, currently Cuba, Iran, North Korea, Sudan, Syria, and the Crimea area of the Ukraine. Some of Mimosa’s encryption items are classified as “Restricted” under License Exception ENC (Section 740.17(b)(2) of the Export Administration Regulations (EAR)) and cannot be transferred without a license to government end-users in many countries. No person or entity may transfer Mimosa products without a license to anyone on a U.S. Government list of prohibited persons, including but not limited to the U.S. Treasury Department’s Specially Designated Nationals List, and the U.S. Commerce Department’s Denied Persons List, Entity List, or Unverified List, without first obtaining authorization from the U.S. government.

Further, Mimosa products may not be used for any chemical or biological weapons, sensitive nuclear end-uses, missiles, or unmanned aerial vehicles, as described in Section 744 of the EAR. Above is Mimosa’s Product Classification Chart. Each product series has a respective Export Control Classification Number (ECCN)(per the United States Department of Commerce Export Administration Regulations), a six digit Harmonized Tariff Schedule (HTS) code (per Customs and Border Protection regulations), and a commodity classification automated tracking system number (CCATS) (per the Bureau of Industry and Security).

The chart also includes the product ENC-Restricted designation prohibiting exportation to government users in many countries. Consult §§ 740.17(b)(2) of the EAR for further details.
